Mr. Kotula successfully represented a major insurance company in the Waste Management environmental insurance coverage action in New Jersey involving claims for over $1 billion of insurance coverage at 134 polluted waste sites in 28 states and in Canada. He served as counsel for a major insurance company in a successful jury trial and subsequent appeals in the ACC Chemical environmental insurance coverage action in Iowa, which sought over $100 million of insurance coverage. Mr. Kotula won summary judgment in the Ross Development environmental insurance coverage action in federal court in South Carolina, involving significant cleanup costs at a former manufacturing facility in Charleston, S.C., which was recently affirmed in the Fourth Circuit. Mr. Kotula counseled major insurance companies in connection with the W.R. Grace bankruptcy action involving very large asbestos liabilities. He represents major insurance companies in high exposure construction and workplace accident and product liability cases, often involving additional insured issues. A frequent author, Mr. Kotula's publications include NEW APPLEMAN LAW OF LIABILITY INSURANCE, Chapter 14: Environmental and Toxic Tort Insurance Coverage Issues (Matthew Bender & Co. 2010), a leading insurance treatise. Mr. Kotula authored a chapter on "As Damages" in The Reference Handbook on the Comprehensive General Liability Policy, published in 2010 by the American Bar Association's Insurance Practice Section. Mr. Kotula has spoken at seminars for the Practicing Law Institute, the American Bar Association, Mealey's and the New Jersey Institute for Continuing Legal Education, as well as at national and international insurance and reinsurance companies. He is the current Chair of the Excess, Surplus Lines and Reinsurance General Committee of the Insurance Practice Section (TIPS) of the American Bar Association.
