Mr. Phelps received his undergraduate degree from Baylor University in 1977 and a Master of Science in Health Care Administration from Trinity University in 1979. Mr. Phelps spent five years working in the field of Healthcare Administration before attending South Texas College Law, where he graduated in 1988. His experience in Healthcare Administration included progressive management and health care positions during a six (6) year period attaining the positions of Vice President for General Services of a 400+ bed acute care facility. He managed 10 department heads and a total of 456 employees. He practiced with several insurance defense law firms rising to the level of Shareholder before starting his own firm in 2001. Mr. Phelps’s legal practice has focused on Health Law issues, where he has utilized his years of experience in Healthcare Administration and his Masters degree in Health Care Administration. The addition of arbitration and mediation services has provided yet another facet for clients in the health care and employment arenas. He has provided administrative and corporate health law services for a variety of health care entities in the Greater Houston area on issues including managed care contracts; various Houston health care contracts; compliance issues, Stark laws, Fraud and Abuse, Anti kickback laws; EMTALA, HIPAA; and representation of health care providers on credentialing and licensure issues before state regulatory agencies. Mr. Phelps is a proponent of advising his health care clients, large and small, to expand their compliance programs to voluntarily include Sarbanes Oxley compliance. He has given numerous seminars and written articles published on many of these issues, including issues before the TMB; Physician Advertising; the Medical Standard of Care; Arbitration; CMS Bundled Payments; Hospital Readmission Reduction Program; Managed Care and Ethics; Human Resource Issues for Physician Practices. At Texas Woman’s University, Mr. Phelps serves as a Clinical Associate Professor and teaches Houston Health Law, Ethics, Human Resources, Marketing, Managing the Hospital, Managing the Outpatient Setting, Long Term Care, and Capstone. He has also been an Instructor at the University of Texas Health Science Center Medical School at Houston. Mr. Phelps is admitted to practice before the United States District Court for the Southern District of Texas. Mr. Phelps is a member of the State Bar of Texas, the Houston Bar Association, and their corresponding Health Law Sections. Additionally, Mr. Phelps is a member of the American Health Lawyers Association. He is the Secretary/Treasurer of the Foundation of the Southeast Texas Chapter of the American College Healthcare Executives.
