Jonathan Shank represents employers in all areas of workplace law, including preventive advice and counseling as well as litigation before administrative agencies and in state and federal courts. Mr. Shank advises and represents employers in a broad range of employment law matters including those involving disciplinary action, discrimination, harassment, retaliation, wrongful termination, wage and hour compliance, whistleblowing, disability management, and leaves of absence. Mr. Shank has represented employers in litigation involving the enforceability of restrictive covenants, claims for defamation, breach of contract, as well as employee stock disputes. Mr. Shank also frequently counsels and defends employers on a variety of issues under the Employee Retirement Income Security Act (ERISA). Mr. Shank’s ERISA litigation experience includes defending against claims to recover plan benefits, breach of fiduciary duty, interference, and other ERISA matters. He also assists clients with ERISA compliance issues, including fiduciary counseling, benefit plan design, and administration modification. Before joining Jackson Lewis, Mr. Shank was an Associate at a large Boston law firm and, prior to that, he completed a judicial clerkship with the Honorable Francis X. Flaherty, Associate Justice of the Rhode Island Supreme Court. While attending law school, Mr. Shank served as Note Editor of the Suffolk University Law Review and competed on the Constitutional Law Moot Court Team. He won the Suffolk Law Jurisprudence Award in Labor Law and interned for the Honorable Mary M. Lisi, Judge of the United States District Court for the District of Rhode Island. Prior to attending law school, Mr. Shank worked as a policy analyst for an international trade association in Boston.
