Jonathan is an Associate in the Health Care, Business and Intellectual Property & Technology Practice Groups. Jonathan has advised clients on a variety of transactions, especially affiliations with physicians and physician groups. For instance, Jonathan has rendered advice related to operating agreements, leases of facilities and equipment, physician employment, professional services agreements, on-call arrangements, Medicare/Medicaid billing issues, physician advertising, in-house pharmacy, and management services relationships. Jonathan regularly evaluates and structures these transactions for compliance with the Stark self-referral prohibition, Maryland self-referral compliance, the Federal Anti-Kickback Statute, and the Federal and Maryland False Claims Acts, among other fraud and abuse laws. With regard to health facility regulation, Jonathan has helped clients navigate Maryland's regulations such as certificate of need (CON), rate setting, and certification by the OHCQ, as well as federal rules for the formation and operation of federally qualified health centers, accountable care organizations, etc. Jonathan has also advised health care providers on a number of medical record issues, including responses to subpoena, transfer of records to a successor practice, general HIPAA/Maryland law compliance review, business associate agreements, and responses to HIPAA breaches and potential breaches. In connection with his medical records practice, Jonathan provides advice regarding trademark, copyright, Internet and computer law matters, such as software licensing agreements, and electronic health record software. Jonathan regularly responds to professional licensing board investigations including the Board of Physicians and others. Jonathan assists regulated health care entities in communications with public officials regarding statutes and regulations.
