Adam has dedicated his career to helping healthcare providers navigate daunting regulatory challenges; he focuses his practice on issues related to fraud and abuse, reimbursement, enrollment, and regulatory compliance. Adam aggressively represents all types of healthcare providers in state and federal courts around the country and before administrative agencies, such as the Centers for Medicare and Medicaid Services (CMS) and the U.S. Health and Human Services Office of Inspector General (OIG). He has successfully defended providers against all types of administrative sanctions, including overpayment assessments (particularly those calculated through the use of statistical sampling and extrapolation), payment suspensions, pre-payment audits, revocations, terminations, and exclusions. He also assists providers facing qui tam suits filed under the False Claims Act and civil healthcare fraud investigations initiated by CMS, OIG, the U.S. Department of Justice, and state Medicaid Fraud Control Units (MFCUs). Adam believes in taking a proactive approach to regulatory compliance, and he regularly advises clients on issues arising under the Anti-Kickback Statute, the Stark Law, and the Health Insurance Portability and Accountability Act (HIPAA). Adam is also one of the most experienced and effective healthcare audit defense attorneys in the country. He has represented countless providers in audits initiated by Zone Program Integrity Contractors (ZPICs), Unified Program Integrity Contractors (UPICs), Recovery Audit Contractors (RACs), MFCUs, and Special Investigative Units (SIUs) of commercial insurance companies. Adam has extensive knowledge of healthcare audit processes, and in many cases he has worked with clients β€œon the front end” to mitigate or even eliminate the possibility of claim denials in pre-payment review audits or overpayment determinations in post-payment audits. In cases where providers are forced to contest adverse audit findings on appeal, Adam has worked closely with his clients to secure reimbursement for denied claims and reverse (or dramatically reduce) overpayment assessments. ​ Adam works with healthcare providers of all sizes, ranging from some of the largest providers in the country to single-physician practices.
